In January Guido reported on Jolyon Maugham’s bizarre campaign backing a Judicial Review against the Charity Commission, which had refused to retract the conclusions of its report into the (now defunct) disgraced charity Kids Company. The judgment is out and it’s bad news for Jolyon as the High Court “dismisses” his challenge on all but two minor points…

The Charity Commission has put out a punchy statement this afternoon which confirms it is “clear that the overall findings of our report were not ‘irrational.’” It said the “High Court judgment has upheld our finding of mismanagement of the charity’s finances and has confirmed that it was based on “ample evidence.'” It adds “firmly rejected allegations we predetermined the outcome of the inquiry, stating the threshold for this was ‘not met in this case by a wide margin.’“ That won’t stop the fox-beater…

The Good Law Project has finally fired up the grift engine and is today soliciting donations for a case against the ruling. Jolyon’s central bizarre argument is that because he failed to have the Supreme Court hear representations from his trans activists during the course of the case the judges are “oblivious” to the Gender Recognition Act. Jolyon’s outfit argues that “Labour’s policy” will treat trans people similarly to the Nazis and the UK is “now in breach of its obligations under the Human Rights Act and the European Convention of Human Rights.” Accompanied by an interesting claim:
“The Nazis forced the LGBT+ community to identify themselves as ‘degenerates’ by wearing pink triangles. Labour’s policy means that for trans people to move through the public sphere they will need, similarly, to identify themselves as trans in an increasingly violent and transphobic world.”

Jolyon is having a difficult time after the ruling of the Supreme Court that the meaning of woman in the Equality Act is a biological female. I spoke to KCs at three leading sets of chambers with deep specialisations in equalities law. Jolyon claims the firm “reversed” a decision to act for an individual “in a case about protecting trans people”. The UK’s Financial Conduct Authority has abandoned plans to require banks and financial firms to set diversity targets for women and ethnic minorities. A number of UK law firms are, on instructions, expunging references to climate actions from their clients’ annual reports, putting UK legal reporting requirements in jeopardy.
