Last week Israel’s ambassador to the UK was summoned to the Foreign Office in a diplomatic protest over their publishing of a planning application. Apparently Hague wanted to show “the depth of the UK’s concerns” about the boost to the Middle East’s construction industry.
Today Egypt’s new progressive president has deployed tanks on the streets of Cairo in an attempt to quell protests against his power grab and constitutional rewrite, yet there is silence from the FCO.

The case is patchy, but I think the general international law argument is linked to:
Article 49 of the Fourth Geneva Convention prohibits an occupying power from transferring its own civilian population into the territory it occupies.
This only applies if you accept that there has ever been a nation state entity called “Palestine” with a people called “The Palestinians”.
As there is no historical evidence to support the premise of an established nation state called “Palestine” I doubt very much that Article 49 of FGC can be envoked.
I did say ‘patchy’.
‘Palestine’ is recognized as a territory, and Article 49 applies to territories not nation states.
The International Community also recognizes the regions where settlements are being constructed as being ‘occupied territories’, with Israel being the ‘occupying force’ – this has been the case since 1967.
On that basis Article 49 can be invoked – and is what is referred to in the ‘international law arguments’. This was reaffirmed in 2001 upon meeting of the Conference of High Contracting Parties to the Fourth Geneva Convention.
Of interest also is Article 47 of the fourth convention which prevents any change of occupied status ‘concluded through negotiations between the occupying power and local authorities under occupation’.
Whilst the actual construction of settlements may not be illegal under international law (but likely is under local law), the moving of the occupiers civilian population into the occupied territory most certainly is.
Forced relocation of occupied peoples by the occupying power within the occupied territory is allowed under Art.49, but usually only for imperative military or security reasons of those people. Relocation for purposes of building settlements is stretching things a bit.
Land acquired during a defensive war is considered fairly won and not occupied territory.

The use of the term “Palestinian” for an Arab ethnic group is a modern political creation which has no basis in fact – and had never had any international or academic credibility before 1967.
The residents of “palestine” are the descendents of immigration which started in the 1870 onwards. Remind you of another EU country that has uncontrolled immigration?
