Quote of the Day

Ken Clarke had a media car crash on 5Live. It got worse on Sky:

“Newspapers are using rape to add some sexual excitement” to the story.

He went on to discuss:

“The classic rape, where someone jumps out from behind a bush….. serious, proper rape.”

      To be fair, this is exactly how the judges see it. They are faced with so many women who get shit faced, have sex consensually then the next morning regret it and phone the police and say they were raped. Not only is this the reason that rape convictions are so low, but it has also resulted in a deep suspicion of women who say they were “date raped”, that is invited someone into their room while drunk who then rapes them.

      I’m not saying he’s right, just that he is consistent with the rest of the legal system.

        That’s a good point, but even and nob, i mean hand, like Clarke should know not to put it so bluntly if that what he meant (I didn’t hear it all just the choice phrases).

        Between him and mad Nads recently, the tories look like they have done a life on mars style lurch back to the start of the 1900′s.

        (I never had the problem of false rape allegations by not jumping into bed with girls on the first night. although back then we called them slags. Being an ugly bugger probably contributed to that as well…)

          The other point he tried to articulate is that the severity of a rape depends on the amount of force used.
          So a 18 year old having sex with a willing 15 year old is rape, but there is no force involved, unlike “more serious” rapes. Unquestionably true, no?

            No, what it unquestionably true is that under the law an 18-year old having sex with a willing 15-year old is not considered rape. It’s still an offence but the law states that it’s under the age of 13 where it’s automatically considered rape.

            So Ken hasn’t even got the basic facts right.

          It’s very hard to establish consent when both parties are pissed, and the presumption has to be of innocence.

          I’m sure that a lot of rapes go unconvinced simply because the legal system is very skeptical of women who say they were raped because of all the liars. It is the liars who ruin it for everyone.

    Dear Mr Justice Secretary
    Please stay within your remit and ivory tower and let’s have the promised White Paper from the Green paper consultation for Breaking the Cycle about the proposed overhaul of the cranky, creaky criminal justice system., to which you received 1200 responses.
    Rape is rape. It either is or it isn’t. Talk to a few women who have gone through it. Doesn’t matter if it was your Uncle Obama / a stranger behind a bush.
    No half way houses and for men who admit, early on guilty please, no reduced sentences.
    Glad that’s settled then.

      I think he got confused in his old age, he was supposed to talk about how Huhne is going to be proper raped in Cell Block B’s showers….

      He did, but not clearly, and quoting that part of the interview spoiled the story anyway.

      Take, for example, two 15-year-olds having sex (it’s not right, but it happens). One of them turns sixteen. It’s then statuary rape if they continue. Is that the kind of rape you normally think of? Probably not. Is it as serious as the kind of rape you normally think of? If you’re answer is not an emphatic YES then you on Ken Clarke’s side. With the media frenzy on the subject at the moment, though, you’d better not admit it though.
