            Let’s face it Guido, there should be hundreds of MPs put before the court, this Lyon chap appears pretty incompetent to me. The Met also appear incompetent and do not appear to understand the criminal offence of false accounting- or perhaps it was a policy decision with Labour ministers to minimise the investigation because of lack of resources. As for the house flippers- Brown, Darling, Blears and co- they have got away with more money than Morley, Chayter and his snouting friends. In fact, I can now understand why the snouters who went court feel they have been singled out amongst the other 322 expense fiddlers. Jacqui Smith only had to give an insincere apology for £116,000. And have their respective faimlies been examined by Inland Revenue for tax on their rental income? Mcnulty imroved his parents home so he can presumably inherit it when they die. he gave an insincere apology as well for his takings on the property ladder. Loads of MPs avoided tax on the property ladder. No wonder McSlug helped the bankers when the property market was centrall to their ill gotten gains. And now, we the tax payer, have to pay for it. Brilliant scam when you think about it. And yet here we are and nothing has basically happened to the thieving revolting scoundrels. Some like Martin were promoted to the House of Lords to join their expenses scam because they do better rates and their home status is more vague- especially if you pay for your title.

            Mc Slug raided private pensions in 1997 and are likely to increase everyones NI or tax contribution to help pay pensions for those on the welfare state.

            Beckett was on Question Time last night and was showing her complete contempt for the public, we paid for her garden accesseries, as a member of Unite and receiving money from them to boost her election campaign. I suggest every public sector worker ops out in paying part of their union subscriptions for political parties. Be in the union if you wish so the money can be used to support you in times of trouble, but do not help McSlug and his thieving gang take every penny away from you in tax and NI. That is pure stupidity. Check your subscriptions and stop Labour’s fund.

    breaking news

    Scotland Yard has passed to prosecutors a new file of evidence against an unnamed parliamentarian suspected of abusing expenses.

    A Metropolitan Police spokesman confirmed the dossier was handed to the Crown Prosecution Service (CPS).

    He said: “One further file of evidence relating to parliamentary expenses was delivered to the Crown Prosecution Service this afternoon.”

    Three MPs and one peer have been charged over their expenses.

    Harry Cohen: To ask the Solicitor-General what criteria the CPS uses in determining whether to seek to prosecute in the UK courts, UK nationals accused of committing serious offences abroad; and if she will make a statement. [51796]

    The Solicitor-General [holding answer 25 April 2002]: In most cases foreign states would normally prosecute offences committed within their own jurisdiction.

    The general rule is that the English courts do not accept jurisdiction where UK nationals commit offences outside England and Wales in the absence of express provisions to the contrary. Some of these statutory exceptions are:

    Homicide as set out in sections 9 and 10 of the Offences against the Person Act 1861. A British subject therefore, who, in a foreign country, within the dominion of a foreign power, murders either a British subject or a foreigner is triable in England under the express provisions of this section.

    Offences of dishonesty and blackmail contrary to sections 1–6 of the Criminal Justice Act 1993.

    Conspiracy, incitement and attempt to commit the offences listed in the Criminal Justice Act 1993.

    Sex Offenders Act 1997.

    Part 12 of the Anti-terrorism, Crime and Security Act 2001, which applies to offences committed on or after 14 February 2002, extends the ambit of the present offences under common law and statute by making it explicit that they cover both the bribery and corruption of foreign public officials and of those in the private sector when committed wholly abroad. It also extends the jurisdiction of the United Kingdom to include acts committed by UK nationals and companies abroad.

    All such cases are reviewed in accordance with the Code for Crown Prosecutors. The Crown Prosecutor must first be satisfied that there is enough evidence to provide

    “a realistic prospect of conviction”. If the case passes the evidential test the Crown Prosecutor then has to consider whether a prosecution is required in the public interest. The code gives examples of public interest factors both for and against prosecution but this is not an exhaustive list. A prosecution will usually take place unless there are public interest factors tending against prosecution, which clearly outweigh those tending in favour.

    However, there is often the need to recognise the fact that the foreign state in which the offence was committed may either want or intend to prosecute the UK national for the same offence. This can necessitate discussion between the judicial authorities in the UK and abroad. Such factors as where the victims and witnesses reside and the views of the victim are also taken into account.
