Rolf Verdict Referred to Attorney General as “Unduly Lenient”

Guido understands a member of the public has complained to the Attorney General’s Office that Rolf Harris 5 year 9 month sentence, of which he will serve three years, is too lenient. A spokesperson says:

“I can confirm that the sentence handed to Rolf Harris today has been referred to the Attorney General’s Office under the unduly lenient sentence scheme. 

“It only takes one person to trigger the process, and there is a strict 28 day time period, which means the Law Officers have until Friday 1 August to consider whether they wish to refer the sentence to the Court of Appeal.”

          His sentencing will be found appropriate, which you may not be aware has to be based on the tariffs in force at the time of the crime.

          What you are commenting on is outside the law. It happens every day, someone is beaten up and they will never be the same again, emotionally, physically or both, yet the perpetrator often walks free without a prison sentence.

However if the legal system is not prepared to do its part and give suitably stiff punishments to violent, dangerous and life ruining criminals, why should citizens leave matters to them and not take justice into their own hands?

            The legal system does it part by implementing the laws set by parliament. Parliament makes the laws that it was elected to make.

            Rather than venting your wrath at Lord Justice Sweeney, it is your MP who can affect the changes you want.

            It doesn’t help that Parliament has also invited European courts into the Justice business and muddy the waters.

        America can already do that with it’s citizens. If you fight for a foreign army you lose your US citizenship. That’s why so many Americans who fought for the British in WWI served as “Canadians”. I’m not sure if it was applied to American s who served with British forces as Americans in WWII, but I believe that a number of Americans who fought in the Spanish Civil War were stripped of citizenship.

    It does raise a question why can a member of the public ask for it to be reviewed. Why should it not be restricted to members of the victims family and other involved in the trial. Otherwise how can someone who may not have attended a day of the trial or the proceeding comment on the sentence and raise a complaint based on what they have seen or read in the media.

      4.5 months in prison and 4.5 months on the tag as the sentence is less than 4 years. Harris, 2 years and 11 months as the sentence was over 4 years and he has to serve half inside.
