Says Ken is Lying, Ed Miliband Mistaken
This morning at his press conference Guido asked Ed Miliband specifically about Ken’s tax avoiding arrangements. Ed Miliband claimed that Boris used a “similar scheme” to that used by Ken – a claim first made by Ken Livingstone himself on the BBC’s Andrew Marr Show this Sunday. Boris is really not happy to be accused of tax dodging.
This afternoon we asked Boris specifically about his tax arrangements. Here is his angry answer in full:
Dear Guido,
You have asked about my business affairs and tax arrangements. Specifically do I have any company or other arrangements constructed to enable me to pay less tax and do I, as has been claimed by the Labour Mayoral candidate and the Opposition Leader, have the same arrangements as Labour’s Mayoral candidate.
The answer is simple and unequivocal in both cases. No.
My salary as Mayor is taxed as an employee of the GLA. In the same way as when I was an MP my salary was taxed as an employee. Any other income that I have received from outside endeavours has been received on a self-employed basis, to me as an individual (no company or other structure has been involved). No income earned by me has ever been paid to a “service” company, through which a person or person’s freelance earnings can be channeled so that they pay corporation rather than income tax.
To suggest otherwise is a complete and utter fabrication.
Of course the real point is not about my tax arrangements. It is about the hypocrisy of a man who for years has railed against those who use special arrangements to reduce their tax and who has then been caught – bang to rights – doing the very same thing himself.

Barclays was obeying the law and was punished retrospectively. Large numbers perhaps, but its actions were completely legal. Their treatment was unfair and the only reason they don’t garner sympathy is that most people can’t see past the £500m figure.
Ken’s actions are also legal, just on a smaller scale. The issue at hand is not the legality of the actions, merely Ken’s rhetoric on tax avoidance, which is worth stating again is completely legal. If you think tax avoidance is wrong, in other words each citizen has an obligation to arrange their affairs to maximise the tax they pay to the state, that’s one thing. But to criticise tax avoidance, or legally arranging one’s affairs to minimise one’s tax liability, and then engage in it yourself is hypocritical.
The main problem is that many politicians (I think deliberately) do not distinguish between tax avoidance and tax evasion, the latter of which is illegal. It’s more than just a technicality, it strikes at the heart of whether you believe in the rule of law or not. If we ban tax avoidance, then we make the argument that every person must necessarily labour to maximise government revenue. Revolutions have been fought over that sort of thing, and we must be very careful not to let the government to take us down that path.

Barclays Bank were doing something which was perfectly legal and had been done by others previously, including Barclays. What we should all question and be concerned about were the actions of the ‘Revenue’. It is far from clear the HMRC have acted according to the Law. They are saying that the arrangement Barclays were using was contrary to the Banking Code, but the Banking Code is not Law, nor ever has been. It is for Parliament to decide what is or is not the Law, and it is most certainly not for HMRC to invent it when they feel like it.
HMRC have effectively suspended the rule of law and said we just want you to give us whatever we think you should give us, regardless of the actual law. This is the same as “gratuity” payments in tin pot African dictatorships run by juntas and mobs.
The de-facto state of affairs in this country is that the wealthier you are, even if you aquired that wealth legally and fairly (Barclays wasn’t bailed out by taxpayers) the less protection you have under the law.
Barclays benefitted from the state guarantees supplied to the entire industry and was thus an indirect beneficiary of taxpayer largesse. All the bankers owe us big time and the many crooks among them need to defend their reputations in a court of law accompanied Icelandic-style by McRuin.

My conclusion is that Mr Johnson was in breach of the rules of the House in failing to register in time his

aware that his shares had any pecuniary value (his holding was of 33 shares each worth £l).
Mr Johnson has apologised for this oversight. He subsequently registered his shareholdings in the Register of
Members’ Interests. His entry has, of course, now been removed since he is no longer a Member of Parliament.
Mr Johnson recognised his oversight therefore and took steps to rectify it. He has apologised. I regard the matter as
now closed. I shall report the outcome to the Committee on Standards and Privileges at its next meeting.
