Sexist Laurie Penny Exploits Unemployed
Pays Staff Below Minimum Wage

It’s a tough life being the New Statesman’s “voice of a generation”, but luckily Laurie Penny – our  favourite privately educated revolutionary who learnt about the hard knocks of life at Wadham College, Oxford – has found the solution to all her problems. Hire some help. She is advertising for an intern to help her with a book, which due to media demands she doesn’t have time to commit to herself. If only she spent more time typing instead of rioting…

The job is to “find statistics and quotes and case studies, talk over what I’m writing and hunt down sources and stories for me, and keep meticulous notes of all sources in academic format.” For this the lowly researcher will be paid the grand sum of £500 for 85 hours work. As a fearless left-wing campaigner for higher living standards for the workers surely Laurie must know that £5.88 per hour is short of the minimum wage and far from the “living wage” she publicly supports (£7.85). Apparently the job would  “suit someone who is currently out of work, working part-time, or parenting”. What planet is she on that she thinks parents can afford childcare on £5.88 per hour?

Even more controversial than the flouting of minimum wage legislation is her contempt for sexual equality legislation. She clearly states: “I’m probably looking for a female researcher”. The EHRC clearly says: “Stating a preference for a man or woman in a job advertisement is unlawful sex discrimination unless the requirements of the particular job mean that it is lawful to employ only a man or a woman”. Form an orderly queue…

UPDATE : Should point out for the sake of completeness that Penny’s practical understanding of unpaid internships was cushioned by the fact that she was lucky enough to have an inheritance to rely on when she was starting out in the media. Not everyone has that advantage…

          That reminds me of the recent amount of anti-smoking bullshit the Beeb have been spouting. Recently they showed a “scientific study” where the “scientists” had added a poison to cigs to see how fast it would damage (in minutes).
          That’s like saying that adding Cyanide to health food means that health food is bad for you.
          Now they are also trying to pretend that the men live shorter than women because of smoking. The whole anti-smoking BS centres on selecting flawed studies and ignoring positive ones.

          Like ignoring the W.H.O. study that found that Pipe Smokers live longer than non-smokers, making a complete mockery of passive smoking “dangers” as well.

          It also centres on blaming deaths of people who happen to smoke on the smoking. Masses of people who have never been near smoke die of what they claim are “smoking related” diseases too, thereby proving that smoke isn’t the main factor.

            I understand more about this than you do. Bizarrely I’ve even worked as a research scientist for a tobacco company.

            I looked up that research paper and they actually put in an isotopically labelled version of a toxin that is already in tobacco, and then they looked how it was metabolised. So they weren’t adding any chemical that isn’t actually in smoke.
            That clearly is a very dull sort of paper that has no place in the mainstream media. Entirely valid in its own context, and to answer the question “how long does it take to metabolise X into Y”.

            And I can swear quite proficiently if you’d prefer?

    Actually, I’ve been quite careful to make sure that anyone doing the work will get at least minimum wage – although it is contract work, rather than salaried work, so the terms are different anyway. I don’t see what’s unclear or unfair about ‘five hundred pounds total for the work, which means it should probably take around 85 hours total at minimum wage, diced up however you feel’.
    Plus, under the terms of the EHRC I have clearly stated WHY the requirements of the job mean that a woman would be better suited to the role – I read the working directive before writing the ad to make sure.

    Because, let’s be clear, I’m MUCH MORE POLITICALLY CORRECT THAN YOU.

          I said ABOUT 85 hours, chopped up however people like – if you read the whole advert, I clearly state that as long as the work gets done I don’t mind at all if people don’t work the full hours.

          Yes I do support the Living Wage, and I dearly wish I could afford to pay it, but as I’m not a huge corporation, but a 24-year old with a salary not much above minimum wage myself, that’s impossible for me at the moment.

            We need some new staff. Love to pay them well but can’t – will try and squeeze the minimum wage to keep in line with the laws n stuff. May have to be flexible about hours etc to keep within the rules. Usually feamles are much better at this sort of stuff.

            Laurie, huge corporations also have budgets.

            Consider the engineer told that his staff budget is being cut by 25%, but the workload remains the same. He can’t cut the wages of his staff because they are set way above his paygrade.

            What does he do? He finds ways to get the work done with fewer staff. Sets priorities, looks for more efficient ways of working. (Yes, I have been there, done that.)

            If you can’t afford to pay someone, do it yourself. Would you work for less than minimum wage with no reimbursement of travel costs or other out-of-pocket expenses? If you can’t find the time, look at your priorities – something may have to wait until you can afford it. Most of us do just that.

    I think you’re being a bit silly about the minimum wage thing. She says “around 85 hours work”. £500 at the minimum wage (£5.93) would be 84 hours and 19 minutes, which I think would come into anyone’s definition of “around 85 hours”.

    Splitting hairs like that just to make a point doesn’t make you look particularly smart.

    On the other hand, you’re quite right to draw attention to the bit about advertising for a female researcher. That is indeed sexist, thoroughly inexcusable, and probably illegal.

      Since you are undecided about the merit of bankers, consider this,

      If it is reasonable to assume that bonus is paid for ‘doing a good job’, it follows that salary is paid for NOT ‘doing a good job’. In the case of our beloved bankers said salary is often numbered in millions.

      To me.this screams out that the problem is not the bankers themselves (would you refuse the offer of a banker-type deal?) but the boards of directors who ‘manage’ the banks and the major shareholders who support them which, in some cases, is the government of the day.

            A little knowledge is a dangerous thing:

            a) “Banksters” were never “taking out bad loans”: that would be suicide. A small subset of bankers who worked in CMBS (commercial mortgage-backed securitisation) found an apparently neat way to keep up with the voracious demand of clients for mortgages by taking their existing loan books (preferably those from weaker customers) and packaging them up with the minimum amount of stronger loans needed to create a package which, overall, resembled a stronger loan according to the rating agencies models so that they could sell them off to banks with no interest in having a client base of millions but the balance sheet to support a loan-like product with strong ratings and reliable characteristics.

            Attributing fault?: Well, customers kept wanting more, banks twisted and turned to keep up and not lose market share, the rating agency models proved too simplistic (particularly by not considering the correlation factors between defaults), regulators didn’t know what was going on. So probably all of the above.

            b) AAA+: The top long-term debt grade is AAA or Aaa (depending on which of the “big 2″ rating agencies you use. There is no AAA+. There is also a top P-1 grade for short term strength.

            c) Not forcing to over-leverage: This is a more serious failing: Banks were tripping over each other trying to keep up with unprecedented demand for personal loans and mortgage debt. In an environment where default rates were so low this could be justified at senior levels, but that was because these rates masked the true story, and arguably this will always happen in a capitalist environment: That would further suggest that good regulator should actually force banks not to over-leverage.

            I am a former banker, not a current one: I have more reason to bitch about the behaviour of the banks than you, as I directly lost my job from the financial melt-down, despite playing no part in the “casino” part, nor getting the six-figure-plus bonuses for which bankers are hated, so please put down your Daily Mail for a moment and breathe normally.

            a) NINJA loans are a US concept, which are intrinsically created through the relative power of mortgage brokers to approve loans (which they did to inappropriate people with much gusto) and the loan-holders (who did not know this was going on), together with a concept in the US of foreclosure, which means that a mortgage-holder cannot lose out if the price of their house drops, by simply dropping off the keys at the bank and walking away. This is an unknown concept in the UK, and probably contributes significantly to “market collapses” seen in the US which are quite unlike the slight wobbles we see in the UK – see parts of Detroit where houses have lost >95% of value as an example.

            FYI this was the key problem: lenders into the US securitisation market, which forms the majority of the global market by a long way, seeing this, got very scared indeed: no amount of interest protection can protect you from that level of loss. Since most investors didn’t appreciate the difference between that market and the UK, the knock-on effect of that meltdown shut down the UK securitisation market and killed Northern Rock.

            When Brown spoke about the problem coming from the US, in the case of the securitisation market at least, he was right.

            You are confusing billions and millions, or if you are talking globally trillions and billions. The UK banks made billions in profit, but only paid millions in bonuses, but I must repeat again since you seemed to gloss over this important point: A VERY SMALL PROPORTION OF BANKERS DO ANY ONE JOB, LET ALONE GET THE BIG BONUSES. So even if these mythical casino bankers existed, rolling the wheel on mortgage loans and laughing everything black came up, you are managing to tar the 100,000’s who work in the London financial sector with the same, very broad brush. Wrongly.

            b) I’m hardly furious, just trying to politely correct an inaccuracy.

            c) And you confuse good market conditions and mortgage availability with some bizarre desire to crap on their neighbour. I challenge you to find a single banker who gets a bonus of more than £10k who actually agrees mortgages for customers. There is a huge disconnect in your argument.

            In return I will find you plenty of idiots who, seeing their bank wouldn’t offer them a 5:1 mortgage, went to another and another until they did. Banks caved in to this madness, and should rightly be castigated for that, but that’s a much different debate to this one.

            d) Since I do not read the Daily Mail, perhaps I am out of touch, but perhaps (and this is madness I realise) the public are so angry with bankers because they have been told to be by the politicians – wouldn’t that be a classic piece of misdirection…

            Fail #1: Your point about bankers worldwide is as irrelevant as me pointing out that worldwide, most professions could be said to earn billions if they have a large enough base group: certainly politicians, but even classically “low-paid” professions such as construction workers (due to the large numbers involved). We have already covered both the ridiculous idea that banks were asking employees to damage themselves and the very small proportion of bankers you are parodying.

    I’m really, really shocked by the level of vitriol and misogny. For those of us who campaign on the doorstep (not that easy in a Northern town) this kind of language and attitude makes it twice as hard.

On the minimum wage, she is on dodgy ground with the ‘about 85 hours’ line, but would be OK if it could be shown that the work actually took no more than 84. As for the suggestion that the job advert is OK, it’s not. It expresses a clear preference for one sex, and sets out a different requirement for men than for women. Definitely indirect sex discrimination, most likely also direct sex discrimination. Admittedly, anyone bringing a claim against her would need to show that they were interested in applying for the job (i.e. insane) and were put off by the terms in which is was advertised.

    OK. Two conversations with the EHRC. One with a “helpline” operator, and one a call back from a case analyst. There is NO EXEMPTION applicable in this case and the opinion is that the wording is illegal.

    I have also discovered that one does not need to apply to and be rejected from the role to lodge a complaint. A complaint can be investigated simply as a reader of the offending advertisement. I have left my details, and been given a case ref number.

    If anyone else wants a go, it can only help. Call 0845 604 6610 and quote the line about preferring a woman.
