This isn’t a surprise.  The Clerk of the Parliaments, Michael Pownall, gave the Lords almost free reign to continue troughing by ruling that there is no definition of main residence for the purposes of expenses.  A ruling almost designed to make a prosecution impossible. Uncharged is not the same as innocent…

        There’s a suspicion here that there would have been a prosecution had it been a Tory peer, especially one with an aristocratic background. I think there may be some truth in it, but I rather think that the authirities did feel that it would send a poor message if the first Female Muslim lord ended up in serious trouble and prosecuted, and I wonder if the clarification of the rules was designed with this in mind.

        It is quite clear that she is guilty of fraud, and had it not been for the ‘new rules’ then she would most certainly have been in the dock.

        Where is Harman now with her ‘court of public opinion!’ I wonder? Is this the wrong case for her argument? Her silence in this matter as leader of the House is suprising at best, as has been Baroness Royall.

          If only that would work. You are assuming that your vote is an affirmative action. It is not. When you vote you have a choice to vote for the party that normally wins in your area or you vote for their nearest opposition. This system means swapsies between lab/con will continue ad nauseam. In some areas there is a three way but that is not the norm by far. The only way is not to vote at all. Then with good concience you can say nothing they do is in your name. The best way to restore the House of Lords to it’s former standing is to clear out all Lords (of all political stripes) appointed since 2000, and invite the Hereditaries to take up their duties again. That system may have been all wrong in theory, but it worked very effectively in practice. As a short-term fix for the problem, whilst a longer-term solution was debated and put in place, that would be the easiest way of cleansing the House of Ermine Vermin, and showing it to have been cleansed.

          One advantage of the old system was that Lords were unpaid, and came to the House generally with no political baggage – they were not beholden to any party, Unions or other influence. As a shield against corruption, that’s about as strong as it can get. Many regarded their constitutional work as a duty – an old-fashioned word having little meaning to the political left, but a very powerful motivator nonetheless.

        For the long term I think that the lords shold comprise of members of various professional bodies (not tax funded quangos, unions or their ilk), to study the affects of the law on the long term interests of their respective professions.

        The professional bodies should reflect all aspects of Britains economy, and should be chartered directly by the Queen (with no political interference) to send representatives in to the house of lords. There are a number of professional bodies already in place for various occupations that could do so. Each representative is their for the duration of their tenure on the professional body, and is funded by and accountable to that professional body.

        I would take some working out, but I think that it best modern interpretaion of the original intentions of the house of lords.

    This is now amended to “Parliamentary allowances are designed to ensure that Members are reimbersed for costs properly incurred in the performance of their duties”.

    Therefore, Gordon has “woolied up” the definition of the rules to make sure no one can be proved guilty.

    Considering the scale of the fraud and deceit afforded by these rules, the CPS have shown themselves to be not fit for purpose (again) by only bringing four cases before the beak.

    Bangladesh’s Vested Property Act (VPA) is a racist law. It provides the government—which really means the corrupt politicians in the ruling party—with the power to seize the homes and farms of innocent citizens and distribute them as graft to their cronies. The VPA has its roots in Pakistan’s Enemy Property Act. After another embarrassing defeat at Indian hands in 1965, the Pakistani government passed a retaliatory law that allowed it to declare citizens (read Hindu citizens) enemies and confiscate their property. The Pakistani law was openly anti-Hindu, which matched the national rhetoric at the time and national sentiment most of the time.

    When Bangladesh passed the VPA three years after its independence, it had to be more circumspect in its description, even though the law was worded to make it clear that the VPA’s substance was no different from its Pakistani forebear. After all, the Awami League politicians who passed the VPA then and now tries to maintain a fiction that they care about Bangladesh’s non-Muslim minorities. Good politics, you know. Moreover, most people still appreciated the fact that Bangladeshi independence was possible about only with the help of Indian arms. But the effect was the same. While the act has been used against other religious and ethnic minorities, Hindus have been the real targets. Professor Abul Barkat of Dhaka University undertook the most authoritative study of the VPA and concluded that by 1997, 40 percent of Hindu families in Bangladesh had been affected by it and more than half of all Hindu-owned land already had been confiscated under the act. Much more land and many more Hindus have been affected in the eleven years since then. So, there is no doubt that the VPA is a critical ingredient in ethnic cleansing. The fact that the percent of Hindus in Bangladesh has been cut in half concurrent with the act is evidence of those even more sinister, ethnic cleansing, motives behind the law.

    The filth calling themselves, ‘House of Lords authorities’, who came up with the rule that peers had to spend just one day a month in a property to claim it as their main home are clearly guilty of:

    1. Aiding and abetting theft from taxpayers via fraud by the criminal scum in the Lords.

    2. Misfeasance: The one-day-a-month rule is illogical, dishonest, deceitful, underhand, and clearly crafted to allow the filth in the House of Lords thieve from taxpayers with fraudulent expense claims.

    3. Nonfeasance: Oviously the filth calling themselves, ‘House of Lords authorities’, knew without question, that the scum in the Lords were submitting fraudulent claims to thieve off taxpayers prior to the one-day-a-month rule being rushed into place to facilitate thieving by the scum in the Lords, and did nothing about it.

Just how hard can that be, and, since Uddin is the one making the claim, should she not have to prove that she has complied with the rule. Could they not have brought charges anyway and left it to the jury to decide?

    Some or you lot are barking up the wrong tree. This scandal has very little to do with ‘Asians’ or another corrupt Asian politician getting away with fraud and theft. That’s just the froth. It’s the means by which Uddin has been able to get away with ripping off our money -so far as least- that matters.

    In this regard, this scandal has everything to do with an incompetent and corrupt champagne socialist Labour establishment using their placemen and women to pervert the administration of the criminal law so as to prevent the wider body corrupt and thieving politicians from having to face justice before the courts (a jury of ordinary folks) for their criminal acts.

    On the one hand we are told theft is theft, and for that reason the defence of Parliamentary privilege does not extend to the 3 (expendable?) troughing MPs who came up before the beak this week. And quite right too.

    Yet in the case of Uddin the DPP is now saying that because the House of Lords authorities had lax main residence rules the case cannot proceed, notwithstanding the clear evidence that Uddin clearly did not live at the premises for which she had trousered pubic money. However, the HoL authorities have now shot the DPP’s fox by Pownall stating that the residence expenses rules he instituted were for internal administrative guidance only and not intended to supplant the criminal law, resulting in the DPP frantically fuming at the HoL authorities. Surely this is a game changer; on the facts alone the DPP will have to open the case again sooner or later. After all, would there be a greater than 50% ‘prospect of a successful conviction’ if the facts of the Uddin case were tested before a jury of ordinary men and women? 99.99 more likely…
