Baroness Scotland Has No Defence
Unless She “Checked and Copied”

baroness scotlandBaroness Scotland was appointed by Gordon Brown to be the government’s chief legal adviser. Prior to becoming Attorney General she worked as a minister in the Home Office, cracking down on illegal migrants and imposing tougher penalties on business and individuals who employ them was passed.

The Daily Mail has Baroness Scotland bang-to-rights, yet she says she did not knowingly employ the Tongan illegal immigrant, Loloahi Tapui, and her spokesman says the Attorney General “saw documents which led her to believe that Ms Tapui was entitled to work in this country” when she hired her.   There is only one statutory defence against conviction for employing an illegal worker under section 8 of the Asylum and Immigration Act 1996 – the act specifies that you get this defence only by checking and copying certain original documents belonging to your employee.

The Home Office guidance on this is clear – you will only be able to establish the defence by checking and copying specified documents, including the passport and “any page containing UK Government endorsements indicating that the holder has an entitlement to be in the UK and is entitled to undertake the work in question.”

Amended ActSo all the Attorney General has to do to clear her name is show us the copy of the page and she is in the clear.  If she has not got that copy, she has broken the law she is supposed to uphold.  Clear and simple.

          Need I go on? I can, ad nauseum. The point is that these people are directly responsible for the making, maintaining and enforcing of the law and the rule of law, yet they are not subject to it themselves. The prospect of an equally corrupt Tory Gov is going to be not one little bit better. At least Aitken and Archer went to prison for being liars. Nowadays, you get promoted.

          All men are created equal, it’s what happens after that that makes it such fun!

      I doubt they’ll be able to find a copy of a pasport that proves she has right of abode/right to remain though. It won’t be enough to just photocopy the passport. The passport has to show the woman has the right of abode.

      The whole point is that you photocopy the document in case the document that you relied on has been forged or a bogus ‘right of abode’ stamp or somesuch put into it which you, in your ignorance, did not reconise as a forgery.

      Then your defence is – I believed this to be a legitimate document. It looks real enough, it’s got the necessary stamp, I didn’t realise it was an elaborate forgery etc etc.

      I think we can safely say..

      Those applying the full force of the law to others have to be seen to be of impeccable character. If they are shown to have broken the law, they must accept their mistake and resign.

      For the last 12 years, resignations have had to be forced. Says all you need to know about the attitude of the current government to the people they claim to represent.

    The TaxPayers’ Alliance said it was unacceptable that MPs left their debts to the public purse unpaid for so long. Food and drink in the Commons is already subsidised by the taxpayer to the tune of £6.1 million a year. The details of MPs’ debts were obtained from the Commons by the Press Association under the Freedom of Information Act.

    They showed that in August, 329 MPs owed a total of £138,046 in entertainment and catering – an average of £419 each. Some £45,150 of that had been due from 77 MPs for more than six months. The figures include MPs’ liabilities from events they have sponsored – giving third parties such as constituents access to Parliamentary facilities – as well as personal bills.

    The Commons also revealed that another £10,018 was owed by 52 MPs in overpaid salaries and allowances. That included £4,229 outstanding from 20 MPs for more than six months. These figures are distinct from the hundreds of thousands of pounds of dubious claims paid back by MPs in the wake of the expenses scandal.
