Frank Cook claimed  back a £5 donation made at a church service to commemorate the sacrifice of RAF pilots.  The left wing MP for Stockton North signed the claim thus: “Battle of Britain church service, Sunday 17.09.06. £5 contribution to offertory on behalf of Frank Cook MP.”  Where do you start?

Multi-millionaire Labour backbencher Mohammed Sarwar claimed £100,000 to cover mortgage interest that he paid from an account with a Swiss bank. Tax needn’t be taxing…

Lord Clarke of Hampstead, former chairman of the Labour Party, admits he fiddled expenses, but he is remorseful. “It looks like I’ve made a terrible error…. I’m responsible for my own actions . . . If I have to go to the wall and my life is finished in terms of political or public life . . . then so be it . . . I regret what I’ve done and shall be seeking to make amends by speaking to the accountants.” Wonder if that “remorseful” line will work for pickpockets?

            Micheal Dodds was just abruptly cut off on BBC Radio 5 when he tried to talk about Blair and Brown’s involvement in sleaze. He was switched off in mid-sentence by the male presenter who went on to make some snide comments about “Tories claiming for their duckponds”.

            The claims that the BBC are trying to make this expenses scandal all about the Tories do seem to have some basis in fact.

        David Cameron uses second home allowance to pay for interest on mortgage on second home. That is what it is for.

        No dispute exists that home is actually his second home, as his wife, and children are based in his first home, and his children go to school at his primary residence.

        David Cameron paid off his much smaller mortgage on his first house from his own funds, shortly after taking out the mortgage for his second home.

        David Cameron doesnt like to have two mortgages, even when the interest of one is being met by the taxpayer.

        The fiend, string him up thats what I say, obviously he has masterminded a crooked scheme the likes we have never seen before. Never before have we seen such an outrageous abuse of the second home allowance, to actually pay for the interest on a second home, which is genuinely used as a second home, and is not situated around the corner.

          Had Labour have managed to have got an elected second chamber – that legislation would not have been blocked. Labour are only talking of Lords Reform and Electoral Reform because they fear defeat. The BBC is busy setting up its own Party of “independents” and all of this is being done without question.     The most important bit of sleaze and one yet to be highlighted to the necessary degree is this little gold nugget of tax avoidance; “the second home 3 year exemption clause”.
    In the yax year 2007/8 this clever bit of tax avoidance triggered by flipping the address of your main home lost the Taxman (us) £14.5 billion. We now know why polticians of all shades but, more especially Government Ministers are loathe to shut of this loophole. Dig a liitle and you may well find they were the “pressure group” most instrumental in introducing this little bit of exploitive artistry onto the statute book of tax laws.
    How contradictory is this bit of allowable tax avoidance with the Government’s recent raising of the higher earners’ tax rate to 50% on the basis if you earn more you should pay more, now I am no socialist and believe enterprise and endeavour especially if it creates jobs for others should be rewarded but, any one person who can afford to buy a second home in these crowdwd islands should be able and willing to pay Capital Gains Tax when they sell it.
    On a final note remember the figures;
    Tax revenue lost through avoidance of Capital Gains Tax when selling second home = £14.5 billion in 2007/8.
    Likely tax raise on an annual basis when higher rate tax is lifted to 50% = circa £3 billion.

      Perhaps you would like to do a little calculation of how much tax revenue has been boosted by artificially inflated house prices. Ex ante there is no reason to expect any real terms increase in house values at all: refurbishment should logically add no more than its cost to value. Perhaps a small element of gain where new facilities have been provided to a neighbourhood – but in many cases there is also loss where over development makes localities less pleasant to live in. Overall, the take from CGT on housing should be small, and there should have been no escalation up the Stamp Duty bands.

      Inflated mortgage requirements have also benefited banks, who have in turn paid large bonuses that are taxed at the highest rate: the collapse of this source of revenue is dramatic. Investment in the housing bubble has crowded out saving for pensions. It has also led to a substantial deficit on the balance of payments capital account, as the funding for mortgage backed securities has been increasingly raised abroad. Meantime the spending due to the “wealth” effect has also trashed the current account while converting yet more house “equity” to taxes (e.g. VAT, car taxes etc.).

      I’m sure you know that the estimate of £3bn for the revenue from the 50% rate is pie-in-the-sky: most reasonable estimates suggest that it will amount to a few hundred million at best. Some not entirely implausible estimates suggest that it may result in a decrease in revenue as high earners flee elsewhere.

They should have warned the public rather than ‘cosying’ up to Labour.

      My constituency MP, Khalid Mahmood, claimed for 9 nights @ £175 a night in a luxury hotel in London with his girlfriend. (He’s a devout Muslim, of course).

      I’ve hoped for years that he could be got rid of, but the odds are stacked against it. The constituency falls into two halves, a smaller northern half, mostly white, and a larger southern half, mostly Asian, so the MP will always be an Asian, leaving the white population effectively disenfranchised.           It would take a clear and heavily supported candidate for the Labour Party to rally behind and they simply do not have one.           He’s still most likely to be there till the bitter end and he will push through whatever “spoiler” legislation against the Tories he can before he goes.

          The Media is already primed for a Labour Disaster come June the 5th and Brown will have his lines ready for them. We’ve seen this before you know.

          And the Media might just want to concentrate on UKIP’s massive vote for a while.

          Which might not be to Cameron’s taste as it could re-open the whole Eurosceptic fracture just when he needed it least. Of course the Eurosceptics might be fine with Dave carrying on as usual we simply don’t know. But he’s not going to promise a referendum on staying in Europe so the Eurosceptics can stamp their little feet all they want about that because it simply ain’t gonna happen.

    I popped into Primark this morning, filled 5 carrier bags with clothes then walked out forgetting to pay. Silly me, an error on my part!

    I was stopped outside the shop by two security guards and escorted back into the shop. How embarrassing for me that the public should be able to see this spectacle, surely that’s a breach of my human rights?

    I realised my error immediately and offered to pay for the items, but the shop refused and called the police.

    I was taken to the police station, searched, photographed, fingerprinted, and had my DNA taken. I tried to offer the nice policeman a monkey to forget about it, but they totally ignored me! What’s this country coming to when a monkey is not enough to persuade a policeman?

    I am now on bail pending a court appearance in 10 days time. Thankfully I know the judge, an old school chum of mine, and I have my alibi ready, so all should be well.

    Here’s that alibi in full:

    * It was an error on my part and I will write a cheque for the full amount now

    * My salary isn’t sufficient to cover the cost of clothes, so I have to top up my income using other means

    * My husband has shoplifted before and said it would be OK

    * I am nomadic

    * My house is the size of Balmoral and you are jealous

    * It was within the rules as I understood them

    * My health is poor

    * I may have done wrong. It’s regrettable but I am not sorry. Can I have my peerage now?

          A second home should be some small place handy to Westminster, if any such ‘second home’ is needed at all.
          Why are second homes mansions and not even necessarily within the MP’s constituency?

      Bonded warehouses are hotbeds of fraud and dodgy deals to reclaim duty and VAT on non-existent goods, or multiple times on the same goods that have been imported, exported, re-imported and so on.

      This all came to light in recent years in respect of mobile phones, but could have been done just as easily on tobacco and alcohol.

    One House of Commons letter dated October 2004 states: “As you know Mr Skinner has had his bathroom redone and is going to submit a claim. I’ve told him that we will pay only £3,500 and he is content with that.”

    The MP said he had decided to refit the bathroom on medical advice following his double heart bypass operation.

    He said the repair work had actually cost £12,000 but he had insisted on keeping the claim down to £3,500 because he had previously voted against an increase in the additional cost allowance.

    “I voted against the increase and I wanted to hold my head up high. That is why I kept the cost of the claim down.

          The name Eric Joyce featured surprisingly late in the long torrent of expenses allegations which have rolled on for the last fortnight, with the Falkirk MP being accused by the Mail on Sunday of twice failing to pay capital gains tax on property sales and of admitting claiming the second homes allowance on what was his main family home.

          The newspaper also claimed he had become the first MP to top £1m in expenses claims since the records began in their present form in 2001.

          Mr Joyce’s claims for last year of £187,334 put him at the top of the claims league for the third time in recent years.

          His main home was in the south of England, where he lived with his two daughters and his wife but he has since separated from his wife and is in rented accommodation.

          When it was put to him by the newspaper that if his former home was not a second home his claims would not have been valid, he is reported to have replied: “This conversation may have cost me £160,000. Have I shafted myself?”

          Asked what he would do if asked to repay, he was quoted as saying: “Suck it and see.”

    In 1945 Labour were elected with a huge majority, then kicked out at the next GE. When you talk to people who voted at that time they weren’t influenced
    by grand speeches about ‘political vision’ but became angry as their day-to-day lives got worse. Food rationing actually tightened after 1945, to the extent that deficiency diseases reappeared due to the shortage of citrus fruits etc. Rationing was administered by a hated Ministry Of Food who were
    called (as one old salt put it) “a bunch of pox doctor’s clerks” – I think that
    means self-important officials who were regarded with derision.

    It seems that NuLab are going to go the same way, with knobs on when you add the charges of hypocrisy and double standards.

A senior Labour source said that the party would look “carefully” at any irregular claims………….Devine’s expenses are now under further scrutiny after it emerged the taxpayer was billed £2326 for joinery services carried out by the MP’s local publican. According to the invoice, the sum was for supplying and fitting 66m of heavy-duty shelving – the equivalent of more than 200ft…At £25 “per lineal metre”, the shelving alone would have cost £1650.     Because if tax was not being paid on the £5, then tax should not have been claimed back. If the church did not know that the £5 had been taxed, they had no legal right to claim. This as tax claimable church contributions are now put into signed envelopes, and are supposed to be kept on record.

    If so, it was a knowing contrived and premeditated fraud of the tax payer, possibly carried out by Frank Cook MP working in conspiracy with the churches book keepers.

      If it was Gift Aided, the Church will have claimed an income tax ‘refund’ on it. This is not conditional on Frank Cook having paid tax on the amount, but it does depend on the amount being a personal donation. If Cook signed a Gift Aid form when handing over the fiver, but intended to reclaim the amount on expenses, he was guilty of a criminal offence in signing a document that he knew to be untrue, as it was not a personal donation.

      In those circumstances the income tax refund was never due and the Church ought to repay it, but of course they would have had no knowledge of that at the time. They would have been entitled to assume that Mr Cook’s Gift Aid form was true and that he was not the kind of shit to claim the amount back off expenses.

      We do not know, of course, whether the collection was passed on to another charity or retained by the Church, but it makes no dfference to the Gift Aid position.

      Very likely he didn’t sign a Gift Aid form, in which case the question doesn’t arise.

      I hope that clarifies the point. Incidentally, £5 is a bit tight for someone on an MPs’ remuneration package.

    Did you read this earlier? Your site didnt respond when I submitted. Not sure that this is a direct Comment to this blog, but have you noticed a theory that the Telegraphs Expenses DVD could have come from Brown’s Bunker itself. At first, this seemed a crazy thought, but consider –
    1 – there has been very little attention paid the horrifying economic situation in the run up to this weeks election
    2 – It has enabled the Bunkers Spin Machine to revive the Tory-Toff theme.
    3 – It will give Brown the opportunity to payback those Backbenchers he dislikes and replace those of the Cabinet that embarrasses him.
    Add to this the known links between the Telegraph editor and Balls (reported drinking partners) and the story starts to become more credible. It also explains why no attention has been paid to the expenses of the Balls/Cooper household. (Are they any better than Julie Kirkbride’s?).

        What was it that T E Lawrence wrote about war and it’s costs, after the First World War :

    Hypothetically speaking, does anyone know the going rate for a ‘hitman’ willing to take out Cat 3 MPs? Whatever the figure, I’m sure it would be cheaper for us members of the general public to rid ourselves of these unconvicted criminals by direct action rather than having to pay them to go away.
    Consider this, removing a mere 27 Cat 3 Labour MPs would preciptate a General Election by removing Mr Brown’s overall majority.
    Think of it as a mercy killing.
    Well, perhaps not. After all, Mr Brown has never shown us any mercy.
