When HM Revenue and Customs (HMRC) receive Blears’ cheque, they will have no alternative but to credit the amount to her personal account, thus pound for pound reducing the tax she needs to pay in the current year. There is no provision allowing for retrospective redesignation of the principal private residence relief once claimed, even if Blears has asked for that which incidentally she doesn’t claim to have done. HMRC have no authority to accept the money as payment in respect of CGT on the property disposed of. The money will remain Blears’.
Sending a cheque to HMRC has provided Blears with (possibly) some positive spin and will have cost her absolutely nothing. Clever, eh?

Actually that raises an interesting point.
It was reported that new MPs in 2005 were told to claim for everything and to max out their expenses in order to “not let the side down”.
I wonder how many Tory MPs got the same advice? It seems a lot of MPs weren’t simply fiddling expenses but were positively encouraged to do so. However under the current regime nothing like that could happen without the full backing of the PM, so that means Blair and Brown have fully supported abuse of the system at the taxpayers expense knowing full well that everything they were doing was outside the rules laid down previously.
It would work as an effective control mechanism, ‘remember the dirt we have on you when we come to discuss this 90-day thing I’m interested in…’

You have to remember the whole reason why they have a second home allowance in the first place. It is unreasonable to expect an MP to perform a long day at Westminster and then make a 4 or 5 hour (or even more in some cases) journey back to their constituency. If you expect your MP to do that then you expect them to work in effect for 24 hours of the day as they would never have any time to actually sleep. Therefore they must have something in place to compensate them for having to stay in London overnight during the week when they are in Westminster. Much in the same way that I would expect my employer to provide me with accommodation expenses if I had to work away from home. Strange as it might seem but Westminster is not actually an MP’s primary place of work, his constituency is his primary place of work. Otherwise no one would ever want to be an MP outside of London.
The issue is not the second homes allowance. The issue is the fact that they have been abusing the second homes allowance in order to receive money to which they would not be entitled to if the expenses were run along private industry guidelines.

The reason the Tories are paying smaller amounts back is because most of it is payments for mortgages and rent. The majority of their claims were related to repairs and gardening expenses, which fell into a grey area with respect to expenses. If you employ a gardener how do you work out which bit is for the lawn and which bit is for the flowers? Labour on the other hand were furnishing property out of expenses, not just once, but sometimes 2 or 3 times. A year!
It’s not the amounts that’s important, it’s what it was claimed for.
That can’t be correct in the cases of Maude, Grayling and Villiers, otherwise there would be no need for them to stop claiming.
The fact that Cameron has required them to stop their claims is an indication that they’re not kosher and ought therefore to be paid back.
And anyway, poor old Villiers seems to be too skint to stop her claim immediately. She’s going to go on claiming for a while and then stop later in the year. If it’s wrong stop immediately and pay it back ffs!!

She is accused of a gross gain of £45k, but perhaps there is an offsettable fee or two (estate agent, solicitor) – then the CGT allowance, balance at 40%.
Fees on the sale of her second property would not add up to £13K. She may have offset some of her annual allowance against the sum.
I hope the HMRC charge her interest on the outstanding balence and then go for her other transactions. After this bitch they pick off all the others as well. That’ll reduce the national debt by a bit.

I hate Labour with a passion, and Ms Blears sits within that monstrous party, but I have to say that the chipmunk doesn’t owe that much tax.
She had the flat for seven years and the gain was 45,000. Deducting the cost of acquisition and the cost of sale reduce the gain to, say 40k, which then attracts indexation relief AND taper relief, reducing the gain to 24,000, less her annual CGT allowance makes the chargeable gain about 14k on which she would owe about 5k tax. Even if HMRC applied a 100% penalty for deliberate avoidance it only takes it up to 10k. That is the worst case. If however she lived in the property as her genuine main residence for a reasonable period (3 Mths +) at any time from 1997 then only 4/7ths of the gain would be taxable at most, say 13,000 but then she would qualify for a 40k CGT break leaving her with a bill of NIL.
Ergo Ms Blears is either donating £13,332 on the basis she doesn’t actually owe anything, or she is paying the tax, and a superpenalty and donating a further 3,000.
Either way that is a pretty big hair shirt to put on and I think she should get some credit for it.

Not correct. HMRC make it clear that if you own two houses you have a completely free choice as to which you can elect to make exempt from CGT. So it is perfectly possible for Blears to get CGT exemption on the same property for which ACA is paid.

given that this is public money I feel that 4 years is inadequate…. how long have most of them been troughing at the bar? I feel also that this should go back to 1997 at the very least. Given all that has been going on, let’s say there are 600 MPs cashing in on expenses to an average tune of about 20,000 a year each. That’s 12,000,000 pounds. A decade’s worth of that is 120million. In that time, there are all the taxes not paid on captial gains to consider as well as the captial gains themselves. Then start on the etceteras and the brown envelope jobbies, the insider investment opportunities, the second jobs….

Brown needs a home in London as an MP and the Grace and Favour home exists only as long as he holds the appropriate office. If the home is empty it needs some looking after and reasonable payment for a cleaner is justified.

Like with Butler/Dodgy Dossier, Hoon will claim that, although he was there all the time, in charge, went to lots of important meetings etc and signed lots of bits of paper, actaully the whole thing had nothing to do with him and he had no involvement in anything at all of any consequence. One might reasonably question whether he is worth paying at minimum wage levels let alone Cabinet troughage rates.
Blears handing over a cheque to HMRC for a non-existent tax liability has two possible consequences – first, HMRC will bank it but will be unable to allocate it to a liability, unless she withdraws her claim to principle private residence in respect of the London flat (in which case she has submitted an incorrect return and could be liable to penalties and interest on top of the tax owed). Therefore they may just allocate it to her income tax liability and she will get a refund either through the PAYE system or after she submits her tax return. If that is the case, I would propose they set it against my liability first.
The second possible consequence is that by rescinding her principle private residence claim for her London flat, she thereby benefits from principle private residence relief in respect of her Salford property for the period in which she owned the flat. Now it may be that the gain in value of that Salford property over the period she owned the flat was greater than the gain she realised on the flat and so by “volunteering” some CGT now she saves herself an even greater tax liability when she comes to sell the Salford property after she loses her seat in the next election and retires to Munchkin Land.
Why did she say she was paying the ‘equivalent’ of £13.5k? Is it just me that thinks the equivalent of £13.5k is, errr, ummm, £13.5k?

I’m surprised that Toerag supporters haven’t yet grasped that what The Telegraph is really doing here is a duel job on the Cameron leadership and Brown and the Labour Party.

But it’s about Tory toffs, primarily. They’ve been hit most by this. Labour aren’t the real target. They’ve been factored in as losing the next election anyway, so no need to target them.

From the stuff so far it’s definitely, and surprisingly, Labour who have looked worse. The Tories’ few grand here and there pales into insignificance with the second home manipulation and tax avoidance schemes on the Labour side, including in the cabinet. In principle Brown paying his brother £6k to clean the flat he didn’t need because we paid for a grace and favour one in Downing Street (and there are many unanswered questions about the claimed arrangements and costs involved), is far worse than Tory man trying to get £1400 for pool cleaning. Brown is the PM , and he claims to operate with a Moral Compass! He transferred the flat to his wife to reduce allow him to claim his second home was in Scotland of course, and to assist with future tax planning – is that not as hypocritical as one can get from the man who insists that everyone pays their “fair share”?
Cameron did an excellent job in addressing his side yesterday and turned it round in my view. Brown is looking like he condones what his lot have done and is struggling to think of something to do that will demonstrate any kind of grasp of the situation. Harman’ attempt to get involved yetsreday was laughably useless, and Brown’s TV effort last night was just wasting everyone’s time. The only way for him to get a grip now is to sack the offenders, withdraw the whiop from lower orders and agree with Cameron and Clegg a new system with no second home stuff, no increase in salary, and only modest, allowable expenses. Anything short of thsi action will be ineffective and a waste of effort. I hope he doesn’t think we’ve forgotten Smith and Uddin who, incredibly, are still in their jobs.
Finally, I can’t be bothered with the Lib Dem bit today, but will proabably allocate an hour or so tomorrow to look at the real heavy stuff the D Tel has been saving for us. I assume the culprits know who they are and are taking evasive action already, but it should be a fun day, especially if ite ends with Balls/Cooper in the dock.

Presumably ginge is completing self assessment returns and the relevant one will need to be investigated and reassessed.If she has not broken the rules,the liabaility will be NIL. Of course,as this becomes a tax matter,it will disappear off the radar. No FOI requests will be possible.
I have seen no actual comment from her which says an equivalent will be paid to charity,although that is suggested on this blog.

I think QE is flowing into equities, causing the current resurgence in share prices. But since companies are losing money the market is chasing a quick capital gain here. Out there in the real economy, lending to companies is extremely risky.
As I have blogged before, somewhere along the line the inflation limit of 2% has quietly been renamed a target of 2%. QE is designed to cause inflation, which can then be paraded as growth.
The ‘smart money’ will take the QE and buy foreign currency, while the pound sinks.
Cameron’s action yesterday has caught the Labour Party offside, so what does the BBC do?
The Brown Broadcasting Corporation is busy this morning trying to big up Gordon Brown’s fanciful announcement that it has been ‘agreed’, as a result of a great initiative of his, that all MPs expenses for the past four years are to be subject to ‘independent’ audit. Never mind that the facts behind Brown’s announcement have been derided as being untrue by members of the very Parliamentary Committee responsible for making such rules. Brown’s claims of all party agreement to the same were a similarly dismissed by the other parties as nonsense and premature.
As I speak Toenails is busy banging on about the potential flaws in Cameron’s actions while keeping his partisan gob shut on the fact that the NuLab government has done fuck all. Jon Snow on Channel 4 news yesterday was just as bad. What is it with these public funded broadcasters?

She will be able to offer the repayment of estimated CGT as a mitigation argument before sentancing by the judge (hopefully).

Let’s not think she’s paid it back until someone proves that HMRC have accepted the cheque as an additional tax laiability for the tax year in question, and also resolved any other aspects of that situiation (eg penalty for non-disclosure/underpayment, any other similar gains not yet declared etc). Until then, it is not sensible to asusme that she has paid back one penny.
By the way, have I missed soemthing or is Smith sitll in her job? Also, whatever has happened to “Baroness Uddin” – presumably she has resigned and sold her flat in Maidstone, with all proceeeds to go to the Exchequer?

Don’t worry about the Hamster – I’ve already arranged for her to claim the 13 grand back as “essential expenses incurred wholly in the pursuit of personal gain” (my interpretation of the rules). Got her a few brownie points with the Revenue at the same time. By the way, I’ve charged her 10 grand for this advice, but she’s claiming that back as well, so everyone’s happy eh?

LIAR Brown said on TV this morning that it was ‘the right thing to do’ for Blears to pay back the estimated £13,000 CGT as she ‘should not profit from the sale of her flat’.
Errr….you only pay CGT on PROFITS, Gordon. So on that reckoning, Blears is still hanging on to more than £50,000 in profit.
Anyway, if HMRC got their teeth into her, she’d have interest and penalties to pay as well. Go get her, boys!

Merely returning a proportion of second home allowances is grossly inadequate. ALL second home allowances, plus accurate interest, should be paid back to the taxpayer, except to whatever extent it can be conclusively demonstrated that these allowances were used to RENT property from non relatives, non friends and non business associates. IN FUTURE, where second properties are necessary, they should be state owned, and occupancy be transferred from one MP to the next.

HMRC to treat them the same as anyone else, late payment fines, interest and where applicable criminal prosecution for tax evasion.
Companies House have fined me £150.00 becase they say they only received my Company Accounts six days after the closing date. Fair enough I’ll pay that sum. But it sticks in the throat becuase I posted the accounts 5 days before the closing date.
If I am fined for being late in a si,ilar context then all these other late paying fucks can take their medicine as well, no exceptions from the highest to lowest.
When it was fist reported that Hazel Blears had volunteered to pay ‘back’ the Capital Gains Tax (CGT) that she avoided through ‘flipping’ her main residence, I wondered whether she was simply naive, badly advised or deliberately deceptive.
f someone, like Hazel Blears, voluntarily pays tax that HMRC’s tax system is not expecting the money will be initially credited to her self assessment (SA) tax account. After a short while this will be checked and if no liability to tax is ‘charged’ to the account the ‘overpayment’ will be automatically refunded. Does she know this?

Given the media’s lack of knowledge regarding the technical aspects of Hazel Blears’ un-selfish “tax” payment, Guido do you know of any way to check the position?
I agree with Mark that: a) either she knows the payment will sit on her Statement of account until it is repaid by HMRC (via Bristol?); or b) it is a payment on account in view of the voluntary disclosure/discovery enquiry of the capital gains tax arising for the tax year ended 5 April 2005 (I think I read the property was sold in August 2004).
If either a) or b), it doesn’t seem such an un-selfish act and may breach the Ministerial code of conduct. I think we should know!
In respect of all these repayments of “misclaimed” expenses, I expect HMRC will be looking to obtain tax under the benefical loans legislation. Won’t they?
