+++ Nadine : I’m Suing Damian McBride +++

She was rumoured to have instructed lawyers this week.  Her blog confirms it this afternoon Just For The Record“:

“I have instructed and proceeded with legal action. Obviously, I am not going to say anything at all at this stage, other than that.”

Guido knows for a fact that the untrue story about her was given to some journalists, and it was alluded to in stories, it was then refined for a second more vicious smear attempt by Damian McBride in the infamous Smeargate emails.

Nadine DorriesGuido understands that legally even if the intended second round of smears were not published widely in print, she has at least two courses of action for slander and defamation because McBride telling journalists the story on his mobile would be slanderous and presumably emailing the smear to Charlie Whelan, Derek Draper and the Unite press officer Andrew Dodgshon would constitute publication (those are the known recipients of the smear at this time).  There are likely to be more people who were briefed by McBride…

Knowingly and deliberately libeling someone was until not so long ago a jailable criminal offence, that has if Guido recalls correctly, been taken off the statute books.  Guido has said it before; do not mess with Nadine Dorries, she is a Tory tigress…

        I must find out if the much heralded censorship of the Internet is now a reality here in Germany! I originally saw this transmission on the German telly (RTL I think it was) a few months ago and wished to see it again – especially for the hilarity of the bit where the silly twat MEP goes and runs into a wall, so desperate is she to escape!

        But guess what? Loosely translated, I get a message informing me that “This video is not available in your country or your domain”. Rats! Could it have something to do with the `stars´ of this clip being only German MEPs d`ya think?

        Truly, I do now regret not buying that Kalashnikov offered to me by a Russkie in Dresden just before they all went home. If only he had had a few bullets to go with it I`d have snapped it up!

      I think its best to watch closely who now damns this move in the press. Maybe it’s those that owe most to McBride.

      Rather nice situation really and well deserved by the bunch of them as they are dammed if they do when they will stick their collective heads over the paraphet or dammed if they don’t as this case goes to court and the names become known anyway.

      McBride does not strike me as someone who will just stand there and take the fall for the good of all. This is going to be seriously messy.

      GUIDO: OK – I am being serious here: is there a decent lawyer in the house? This seems to fit more a case of ‘malicious falsehood’ rather than a highly damaging libel or slander. And Guido, did McBride actually PUBLISH the allegations about her, or did he marshall together his ideas with intent to publish at a later date?

      I think she’s on a sticky wicket: if she proceeds with a libel case and she wins she gets little damages because the allegations have not seriously damaged her in actuality – in fact they have considerably raised her profile in a positive way and she’s now known more widely than she could have dreamed of – all in a positive sense. I can just imagine the late George Carman arguing that she benefited from the rumpus. She could argue she has bruised feelings but she’s a pol, and should be used to it. Also McBride did not publish widely – so that would also impact the level of damages. And of course, all those that helped to puff up the allegations by carrying them could also find themselves as co-defendants, could they not? And I can just see the journos queuing up to say they were the recipients of his briefs on her…….

        Some blog responses on some sites can be read as still taking the smears about her seriously and at face value; she might be able to argue that as long as the material is continuing to surface here and there, her reputation is still suffering.

If she calls them into court alleging that their source was McBride, their response will be interesting. If they decline the opportunity for revenge against McBride they will refuse to name their source(s). On the other hand…

        I don’t know a lot about defamation law, but do have some idea. When it comes to libel, a statement only has to be “published” to one person which, I think, would mean that sending someone a defamatory email would count as libel.

        I think malicious falsehood is something different. For example, if you were a pop singer and I had a grudge against you and told everyone you had cancelled your tour, which meant they didn’t buy tickets, then that would be a malicious falsehood.

        But it’s also worth pointing out that with libel, you don’t have to actually prove damage, only that the statement is the kind of thing that is likely to damage your reputation.

        With slander, you do actually have to prove that you’ve been damaged by it, which is one of the reasons that there are fewer slander cases than there are libel ones (along with the fact that the nature of libel means there will usually be more evidence of it).

I’m sorry that Ms Dorries was smeared but she’ll be throwing good money down the throats of lawyers and putting herself under stress for some time to come if she takes this to court. And everyone now knows Mcbride’s an unpleasant piece of shit thanks to Guido’s recent bit of public service, so it’s not as if anything McBride may or may not have said about Ms Dorries carries any currency.
        Stay clear of the courts – it’s easier to screw them in the court of public opinion. And anyway, because she’s an MP, Dorries could use Parliamentary privilege to cause havoc on the Nulab benches provided she has sufficient colleagues willing to play ball.
        Beware of lawyers bearing gifts – they’re all liars.

        I understand (having been the vitim of an online libel myself recently) that there is a criminal offence of ‘Conspiracy to Publiash a Libel’ and the allegations in this case seem to fit. I do think however that Guido should take advice on whether it’s advisable to remove some of the McBride material here in case it could prejudice the court case

      Btw, Neil Hamilton’s relentless efforts to clear his name in the aftermanth of the Guardian/Fayed sleaze smears were what prompted me to look into the whole thing in some detail. His reaction was simply not that of a guilty man. Those accused who were guilty, admitted it and accepted their fate. I am convinced of his innocence and if the usual media suspects had not ensured an almost total news blackout of the investigation into the case by a pair of brave hacks, more people would realise it. Yet in the blogs and in the media, everyone still feels free to hurl any kind of personal abuse at the man.

      “No smoke without fire” is imo the stupidest – and cruellest – cliche in the language.
      It was quoted at me – and no doubt many others who have been smeared for any reason.
      I’ve seen it being used in the case of Norries.

      In the same way, a lot of the childish abuse of Labour politicos on here and other blogs alleging all kinds of sexual misdemeanours, etc, are probalby libellous and likely to be counter-productive. some are very funny but we would imo be collectively more effective if we cut out the personal stuff and kept it ‘cool’

No application to make Italy conveniens would succeed. There is also the question of the domicile of any other party (newspapers, their journalists?).

      But it will take some time to get the documents and then get them into the public domain (you are not allowed to use documents you get on disclosure for purposes outside the legal action in which you got them).

      And it will take time. But, with a bit of luck, it will be coming along nicely about this time next year.

        In most litigation documents are circumstantial to the events complained of but in defamation they are critical, but you cannot simply fish for publications in order to sue.

        The Claimant sets out their case and the Defendant responds to that case. Here the Defendant is likely to know far more about the various publications than the Claimant but will have no duty to help her so the “letter of claim” will have to set out an identifiable occasion when the defamatory words were published and if there is any guessing involved there will be pitfalls ahead.

        Like everything in law, discovery is a game; there is absolutely no obligation to disclose (usually) but if you don’t you can’t use the “undisclosed evidence” in the proceedings. This is good, though as I have said before it doesn’t apply in Italy.

    As far as I can see there can be no defence to this action unless McBride intends to assert that the allegations are true and can establish them.I understand they are conceded to be fiction.The only question therefore is the amount of damages and whether aggravated or exemplary damages are available.God knows McBride already looks more than 34.He may look like an OAP in a week.

I just think that given her track record she’s going have a hard time proving that a rumour which she herself has done as much as anyone (with the possible exception of our host) to spread has actually lowered her reputation.     Guido I usually enjoy your blog. I don’t agree with your cynical take on politicians, in the end I think many try and do the best they can. Spend a morning in a politicians surgery to see the stuff they deal with all the time.
    But I think your astringent approach can illuminate dark corners and achieve real results.
    So why you celebrate this mediocre (at best) politican I have no idea. Nadine Dorries is a sign of everything that’s wrong with politics. Wedded to a single issue (abortion) and at best well intentioned at worst stupid. Check out what Ben Goldacre has to say about her at badscience.net.
    What will she achieve in the next government? She is just political baggage that will be carried into power at the next election. She isn’t good enough. It’s MP’s like this you should really be gunning for.
    Frankly I’d rather have a smart MP fiddling expenses who has two brain cells to rub together than this awful woman.
    She is indeed a modest woman, with much to be modest about.

    I believe the point that a few people are missing is that this is quite a clever strategy. The issue is not about whether or not Nadine was slandered or libelled (I think she was btw), but one of keeping the story of Labour’s disgusting spin machine topical and in the eye of the public. I doubt she is doing this without the support of Cameron.

    For those who mistakenly believe that Cameron is going to easy on Brown, I think this shows some steel. Don’t forget that in PMQ this week that apart from Nadine, no other Tories were attempting to be called by the Speaker. This indicates direction from the leadership and whips to enforce discipline. Positive signs that Cameron has the party under his control and that his strategic leadership is respected.

    The other great thing about Nadine Dorries is that she is a very typical, normal decent middle-England woman, and very attractive to that important voting demographic. Very, very foolish of Brown, McBride and the lackeys to target her. But then again, no surprise that they goof up on this, as they do on everything else.

        The revised (downward) forecast was actually that provided by our own government’s Office of National Statistics, not the IMF.

    The initiation of legal action by Tory MP Nadine Dories against a hard working civil servant who has recently had the misfortune to lose his job (in the middle of a recession that started in America) is both vexious and vindictive. Vexious because he never actually published the email. He simply sent it to his very good friend Dr Draper for a second opinion. After consideration they both then realised what they were doing was both very juvenile and wrong and immediately deleted it. They have subsequently both apologised after the private email was leaked and then published by the Tory press. It is vindictive because this action is being funded by wealthy Tories who have little interest in this matter other then to use it as a vessel to create damaging publicity in an attempt to embarrass Gordon Brown. This is simply being used as a diversion to cover over the facts that the modern Conservative party has no policies to help hard working families and businesses as they struggle with the consequences of the world recession. Only the Labour party cares about ordinary working people and it is to be regretted that a Tory MP is trying to fuel this story further and push what was really just a juvenile prank into the Civil Courts who probably have far better things to do.
